
Maiman, a 21 year old student at Yale University, has filed a lawsuit against the US Airways as his Xbox 360 was stolen on their flight. On Dec. 17, 2008 he took a flight from New Haven to Cincinnati/Northern Kentucky International Airport. With him he had his Xbox 360 which upon landing had mysteriously vanished, along with its components. He claims that his Xbox 360 was equipped with a “specialized” hard drive, which (including other components) costs $1,700.
Upon landing when he checked his baggage he found out that everything other than his precious Xbox 360 (and components) was in place. He immediately informed the US Airways officials about it but in return all he got was ‘nonresponsive answers’, even after writing and speaking to five airline employees for weeks. Now he has filed a million dollar lawsuit against the US Airlines on the grounds of “non-economic distress”. As per the suit the airline must pay him $1,700 for his lost goods and at least $25,000 for non-economic distress, which at max can be a sum of $1,000,000. This is what the US Airways spokeswoman had to say:
We haven’t been apprised of any lawsuit yet, but regardless of the figure in the complaint, there are federal loss limits applicable to all airlines on their liability for lost luggage and belongings, which are currently set at $3,300 per bag. Further, our publicly available baggage policies specifically exclude liability for electronics checked in luggage.
